PlanCare New Client Welcome Offer: Terms and Conditions

Part 1 — General terms

Part 1 applies to all offers conducted under this Policy: Schedule A (Client Referral Offer), Schedule B (Provider Referral Offer), Schedule C (ONEteam Partner Referral Offer), and Schedule D (New Client Welcome Offer). Part 2 sets out the terms specific to each Schedule. If there is any inconsistency between Part 1 and a Schedule, the relevant Schedule prevails to the extent of the inconsistency.

1. Promoter and application

1.1 This Policy is issued by PlanCare Group Pty Ltd (ACN 658 231 157) of Level 17, 109 St Georges Terrace, Perth WA 6000 (PlanCare, we, us, our).

1.2 This Policy governs the Offers set out in Schedules A to D (each an Offer, together the Offers).

1.3 Participation in any Offer, or acceptance of any reward under this Policy, is deemed acceptance of this Policy in full.

1.4 This Policy applies only to PlanCare's Support at Home clients. It does not extend to, and must not be administered, offered, or communicated in relation to, any person who receives services from PlanCare under the National Disability Insurance Scheme (NDIS).

2. Promotion Period

2.1 Each Offer runs during the period commencing 12:01am (AWST) on 1 July 2026 and ending 11:59pm (AWST) on 30 September 2026 (Promotion Period), unless varied, suspended, extended or terminated under clause 13.

2.2 A New Client's eligibility is fixed by reference to whether their Referral (where applicable) and Active Client commencement date fall within the Promotion Period. A milestone that falls due after the Promotion Period ends remains payable, provided the New Client became an Active Client during the Promotion Period.

3. Definitions

Active Client means a client of PlanCare who has (a) an in-force, signed Service Agreement with PlanCare; and (b) is receiving PlanCare-coordinated home care or support services on an ongoing basis under that Service Agreement, where those services have not been suspended, paused beyond what is permitted by clause 6.2, terminated, or otherwise ceased.

Calendar Quarter means each of the periods 1 January to 31 March, 1 April to 30 June, 1 July to 30 September, and 1 October to 31 December.

Consecutive Days has the meaning given in clause 6.2.

Gift Card means a physical or electronic gift card issued by or on behalf of PlanCare, redeemable in accordance with the relevant gift card product's own terms and conditions.

New Client means a person who (a) has not had an active Service Agreement with PlanCare at any time in the 12 months immediately before being referred or introduced under an Offer (disregarding, for this purpose, any prior enquiry, assessment or referral that did not result in a Service Agreement); and (b) commences as an Active Client during the Promotion Period.

Referral means a valid, PlanCare-registered introduction of a prospective New Client made in accordance with clause 5.

Referral Provider means an organisation or individual that holds a valid, positive verification status with PlanCare, entitling it to refer prospective clients under Schedule B.

Referring Client means an existing Active Client of PlanCare who makes a Referral under Schedule A.

ONEteam Partner means an organisation that holds a valid, positive verification status with PlanCare as a partner under PlanCare's ONEteam partner program, entitling it to refer prospective clients under Schedule C.

Service Agreement means the agreement between PlanCare and a client under which PlanCare provides or coordinates services to the client under the Support at Home program.

4. Eligibility and exclusions

4.1 To receive a reward under any Offer, a participant must satisfy the eligibility criteria for the relevant Schedule in Part 2, and must not fall within any exclusion in clause 4.2.

4.2 The following are excluded from participating in, or receiving a reward under, any Offer:

  • current employees, directors, officers or contractors of PlanCare, and their spouses, partners and immediate family members;
  • any related body corporate of PlanCare, or its employees, directors or officers acting in that capacity;
  • a New Client referring or introducing themselves;
  • any person whose relevant PlanCare services are provided or funded under the NDIS (see clause 1.4);
  • a person who was already an Active Client, or who had an active enquiry, assessment or service agreement in progress with PlanCare, immediately before the Referral was made, unless PlanCare determines in its sole reasonable discretion that the Referral genuinely and materially contributed to that person becoming a client; and
  • any Referral, enquiry or client relationship that PlanCare reasonably considers has been manufactured, duplicated or artificially structured to generate reward payments that would not otherwise arise (see clause 14).

5. Making a valid Referral

5.1 A Referral is only valid if it is submitted via the dedicated referral webpage established by PlanCare for the relevant Schedule before the New Client's first recorded contact, enquiry or assessment with PlanCare.

5.2 Only one Referring Client, Referral Provider or ONEteam Partner will be recognised for any one New Client. Where more than one valid Referral is submitted for the same New Client, PlanCare will recognise the first Referral validly registered in its systems, and PlanCare's records are conclusive evidence of that sequence.

5.3 A Referring Client, Referral Provider or ONEteam Partner must have the referred person's consent to provide their contact details to PlanCare for this purpose, consistent with the Australian Privacy Principles.

6. Active Client status and Consecutive Days

6.1 A milestone (90, 180 or 270 Consecutive Days, as applicable) is only met where the New Client has accrued that number of Consecutive Days as an Active Client.

6.2 The Consecutive Days count only accrues on days the New Client is actively receiving home care or support services under their Service Agreement. Any pause or interruption to services, or any termination or cessation of the Service Agreement, will reset the Consecutive Days count to zero unless PlanCare determines otherwise at its sole discretion.

6.3 If a New Client's Service Agreement terminates for any reason before a milestone is reached, no reward is payable for that unmet milestone, and any linked Referring Client, Referral Provider or ONEteam Partner reward does not become payable.

7. New Client reward track — Schedule A/B/C vs Schedule D

7.1 Each New Client is entitled to only one New Client Reward track under this Policy:

  • where the New Client is introduced via a valid Referral under Schedule A, B or C, the New Client Reward set out in that Schedule; or
  • where the New Client is not the subject of any valid Referral (for example, because they were acquired through PlanCare's own marketing or other organic channels), the New Client Reward set out in Schedule D.

7.2 These two tracks are mutually exclusive. A New Client cannot receive a reward under both Schedule D and Schedule A, B or C.

7.3 The referral-side reward payable to a Referring Client, Referral Provider or ONEteam Partner under Schedule A, B or C (as applicable) is payable independently of, and in addition to, whichever New Client Reward track the New Client receives under clause 7.1.

8. Gift Card rewards — issuance

8.1 Gift Cards will generally be issued as physical gift cards, sent by registered post to the recipient's last known postal address held by PlanCare, at the commencement of the next Calendar Quarter following satisfaction of the relevant milestone. PlanCare reserves the right to issue a Gift Card electronically instead (for example, to the recipient's nominated email address), at its discretion.

8.2 Gift Cards are subject to the terms and conditions of the gift card product used to fulfil the reward, including any applicable expiry date. PlanCare is not responsible for that product's terms, availability or redemption process once a Gift Card has been correctly issued.

8.3 Gift Cards are not transferable, cannot be exchanged for cash, and will not be reissued if lost or stolen after correct delivery to the recipient's last known postal address (or nominated email address, where issued electronically).

8.4 It is the recipient's responsibility to ensure PlanCare holds a current and correct postal address (and email address, where relevant) for delivery.

8.5 If a Gift Card sent by registered post is returned to PlanCare as undelivered, PlanCare will make reasonable efforts to contact the recipient to arrange redelivery, but is not liable for any delay or non-delivery caused by an incorrect or outdated address held by PlanCare, or the recipient's failure to collect a card requiring signature on delivery.

9. Referral fee rewards — invoicing and payment

9.1 Referral fees under Schedule B and Schedule C are only payable once PlanCare has verified that the relevant milestone and all eligibility criteria have been met.

9.2 To claim a referral fee, the Referral Provider or ONEteam Partner must submit a valid tax invoice to marketingincentives@plancare.com.au, which must:

  • include a single line item reading "Client Referral Fee – [Client Full Name]" (Schedule B) or "ONEteam Referral Fee – [Client Full Name]" (Schedule C);
  • state the correct invoice amount for the applicable Schedule, plus GST if applicable; and
  • include the claimant's ABN, or a statement of the reason no ABN is quoted, where relevant.

9.3 Payment will be made in accordance with PlanCare's standard Accounts Payable terms, being payment within 30 days of receipt of a valid, verified invoice.

9.4 PlanCare may request reasonable supporting information to verify a claim before payment, and may decline to pay an invoice that does not meet the requirements of this clause 9, or that relates to a client who is not, or is no longer, an Active Client.

10. Taxation

10.1 Recipients are solely responsible for determining and meeting their own tax obligations (including income tax and, where applicable, GST) in respect of any Gift Card or referral fee received under this Policy. PlanCare does not provide tax advice, and nothing in this Policy is intended as such.

10.2 Referral Providers and ONEteam Partners must ensure their invoices correctly reflect their GST registration status.

11. Interaction with care and support services

11.1 Participation in, or receipt of a reward under, this Policy does not affect: (a) a client's rights, choices, or the care and services provided to them under their Service Agreement; (b) PlanCare's obligations under the Aged Care Act 2024 (Cth) or the Support at Home program; or (c) a client's right to cease, vary or transfer their services at any time.

11.2 No reward under this Policy is conditional on a client receiving, continuing, or increasing any particular type or volume of care or services, beyond continuing to meet the Active Client definition in clause 3.

11.3 PlanCare will administer this Policy consistently with its obligations to consumers under the Aged Care Quality Standards, and reserves the right to decline or modify any reward arrangement it considers inconsistent with those obligations.

11.4 This Policy is restricted to Support at Home clients under clause 1.4. PlanCare will not offer, administer or promote any Offer to a person in connection with services provided or funded under the NDIS.

12. Privacy

12.1 PlanCare will handle personal information collected under this Policy in accordance with its Privacy Policy.

12.2 By submitting a Referral, the Referring Client, Referral Provider or ONEteam Partner represents that they have the referred person's consent to share that person's name and contact details with PlanCare for the purpose of following up the Referral.

13. Variation, suspension and termination

13.1 PlanCare may, at any time and without liability, vary this Policy, or suspend, extend or terminate the Promotion Period or any Offer, where reasonably necessary (for example, due to unforeseen circumstances, suspected fraud, or a change in law or regulatory guidance), by notice on its website or to affected participants.

13.2 A variation, suspension or termination does not affect a reward that has already become payable in accordance with this Policy before that change.

13.3 PlanCare's decision on any matter relating to this Policy, including eligibility, verification and reward calculation, is final and binding, acting reasonably and in good faith.

14. Fraud, false claims and clawback

14.1 PlanCare may withhold, cancel, reclaim or set off any reward (including a Gift Card value or referral fee already paid) where it reasonably determines that a claim, Referral or Active Client status was based on false or misleading information, or was obtained in breach of this Policy.

14.2 PlanCare may take any other action it considers appropriate in response to suspected fraud, including referral to appropriate authorities.

15. Liability

15.1 To the maximum extent permitted by law, PlanCare excludes all liability for loss or damage (including indirect or consequential loss) arising from participation in this Policy, other than liability that cannot be excluded under the Australian Consumer Law.

15.2 Nothing in this Policy limits a person's rights under the Australian Consumer Law, or a client's rights under their Service Agreement.

16. Governing law

16.1 This Policy is governed by the laws of Western Australia, and each participant submits to the non-exclusive jurisdiction of the courts of Western Australia.

Part 2 — Schedule-specific terms

Schedule A — Client Referral Offer

A1 Eligibility: an existing Active Client of PlanCare who makes a valid Referral (clause 5) of a New Client during the Promotion Period (Referring Client).

A2 The Referring Client must remain an Active Client at the date their reward is due to be issued. If the Referring Client has ceased to be an Active Client before issuance, the reward in the table below is not payable.

Schedule B — Provider Referral Offer

B1 Eligibility: an organisation or individual that holds a valid, positive verification status with PlanCare as a Referral Provider at the time the Referral is made.

Provider payment

The Referral Provider will receive a $500 referral fee once the referred New Client has completed 90 Consecutive Days as an Active Client, claimed in accordance with clause 9 (tax invoice to marketingincentives@plancare.com.au, single line item “Client Referral Fee – [Client Full Name]”, $500.00 plus GST if applicable, paid per PlanCare's standard Accounts Payable terms following verification).

New Client reward

This is a standalone reward, separate from and not additional to Schedule D (see clause 7). It is only payable where the New Client was introduced via a valid Referral under this Schedule:

Schedule C — ONEteam Partner Referral Offer

C1 Eligibility: an organisation that holds a valid, positive verification status with PlanCare as a ONEteam Partner at the time the Referral is made.

Partner payment

The ONEteam Partner receives a notification once the new client's first invoice has been processed, with the referral fee claimed in accordance with clause 9 (tax invoice to belinda@plancare.com.au, single line item “ONEteam Referral Fee – [Client Full Name]”, $500.00 plus GST if applicable, paid per PlanCare's standard Accounts Payable terms following verification).

New Client reward

This is a standalone reward, separate from and not additional to Schedule D (see clause 7). It is only payable where the New Client was introduced via a valid Referral under this Schedule:

Schedule D — Direct New Client Offer

D1 Eligibility: any New Client who commences as an Active Client during the Promotion Period through PlanCare's own marketing or other organic channels, and who is not the subject of a valid Referral under Schedule A, B or C.

D2 A New Client who is the subject of a valid Referral under Schedule A, B or C does not receive a reward under this Schedule D. That New Client instead receives the New Client Reward set out in the applicable Schedule (see clause 7).
